It's easy to see how it probably happened. A producer racing against deadline quickly searched for an image on the Internet and, bam, the BBC had itself a big ol' gaffe.?Honestly, as a busy reporter?under?constant deadline pressures myself, I feel their?pain. Still, you've gotta double check ... and then you have to triple check.

The BBC has, of course, apologized for the its mistake via?Eurogamer.

BBC News makes every effort to ensure the accuracy of all images broadcast, however very occasionally mistakes do happen. 'Flaunting it': Gay bar bans straight bachelorette parties

The Abbey nightclub in West Hollywood, Calif.,?regularly welcomes customers who are not gay. But operators say there will be an exception to that policy until same-sex marriage is legal across the land.

?We love our straight girlfriends coming in to celebrate one of the happiest days of their life," says Abbey owner David Cooley. "But it?s also a slap in the face to my customers and my life that we can?t have that same celebration.?

Male go-go dancers are just one reason why one of America's most popular gay bars has become a big draw for straight women's bachelorette parties.

Each weekend, The Abbey hosts several dozen ladies night parties. But Cooley says, no more. Until marriage is legal for everyone, straight women can no longer celebrate their pending nuptials at his club.

His position is getting mixed reviews from both gay and straight customers.

?Everyone should be able to get married," says Roshanna Sabaratnam. "We shouldn?t, as straight people, be flaunting it in front of people who can?t.?

But, there are also some gay customers who disagree.

?I think the ban is an interesting approach to the debate about gay marriage," says Alexander Villalobos. "But I think you shouldn?t limit other people?s rights in order to get yours.?

Apparently not. Or at least, not so far. That is one reason that talks between Iran and the US and other world powers on Iran?s nuclear program ended Thursday without any agreement ? except to reconvene the talks in Moscow next month.

The two days of talks in Baghdad failed to narrow differences between the two sides over how a deal easing international tensions over Iran?s nuclear program should look.

Iran wants a significant easing of the existing and looming sanctions on its economy, including its life-blood petroleum industry, in exchange for any concessions. But world powers want Iran to give up its stockpile of uranium enriched to 20 percent purity ? a level that can be further purified relatively quickly to the 90-percent-enriched uranium to fuel a nuclear weapon ? but without any roll-back of sanctions, at least initially.

The proposal presented to Iran includes a list of other incentives, and that?s where the airplane parts come in. But so far Iranian officials are scoffing at the seriousness of the proposal presented by the European Union?s foreign policy chief, Catherine Ashton, who is leading negotiations for the world powers.

?Giving up 20 percent enrichment levels in return for plane spare parts is a joke,? Hassan Abedini, an executive with Iranian state-run media who was briefed on the talks, said in comments to the Associated Press.

The Iranians want an immediate easing of sanctions to be part of any deal, but so far the world powers ? the US, Russia, China, Britain, France, and Germany ? are not biting. US officials insist privately that it was the increasingly severe sanctions that brought the Iranians to the table in the first place.

In comments to reporters in Washington Thursday after the conclusion of the Baghdad talks, Secretary of State Hillary Rodham Clinton was adamant that sanctions would not be eased any time soon ? certainly not before talks reconvene in Moscow June 18.

?As we lay the groundwork for these talks, we will keep up the pressure,? she said.??All of our sanctions will remain in place and continue to move forward during this period.?

Yet even amid the refusals to budge on both sides, the discussions were apparently promising enough for the parties to agree to keep the talks going.

?It is clear that we both want to make progress, and that there is some common ground,? Lady Ashton told reporters following the talks. Despite the ?significant differences [that] remain,? she added, ?we do agree on the need for further discussion to expand that common ground.?

The world powers may see some advantage in allowing three weeks to go by before talks reconvene ? for one thing, that will take Iran closer to imposition of the European Union?s embargo on Iranian oil imports, and deeper into US sanctions on its central bank.

But the delay also involves some risk ? in particular that Israel, and allied members of Congress, will dismiss the extended time frame for negotiations as merely an opportunity for Iran to continue enriching uranium and progressing towards ?nuclear weapons capability.?

And that could prompt Israel to renew its threats of launching air strikes on Iranian nuclear facilities. Already on Wednesday, Israeli Defense Minister Ehud Barak said that an agreement by Iran to open its facilities to more intrusive United Nations inspection would not be enough for Israel to desist from weighing military options.

In her remarks, Secretary Clinton appeared to try to address anticipated criticisms of the negotiations calendar by emphasizing what she called the unprecedented unity of the world powers in their approach to Iran.

?I think if you had asked three and a half years ago, certainly when I started this job, could we have unity around some very difficult issues with Iran and have everybody onboard speaking literally off the same page with the same voice, there would have been a certain level of skepticism,? she said.

The question now will be whether that ?unity? that includes Russia and China, traditionally more sympathetic to Iran?s perspective on its nuclear program, will be enough to cool demands for not just talks but action on Iran.

(AP) ? Hurricane Bud lost a little of its sting early Friday, but remained a potent Category 2 storm as it headed toward a string of laid-back beach resorts and small mountain villages on Mexico's Pacific coast south of Puerto Vallarta.

Authorities canceled school in 11 communities expected to be hit by heavy rains in Jalisco state, and emergency workers were preparing emergency shelters, many of which would be located in empty school classrooms.

Heavy rains and 6-foot (2-meter) high waves had already started pelting Melaque, a beach town on the Bahia de Navidad, about an hour's drive east of the sparsely populated stretch of coast where the hurricane's center is expected to come ashore.

Rafael Galvez, the manager of the Hotel Bahia in Melaque, said his staff was preparing to board up windows in preparation for Bud's arrival.

"For me, really, this is my fourth hurricane, I went through Wilma in Cancun," which hit as a Category 4, Galvez said. "This is a little less severe."

Category 2 Hurricane Jova hit the area in October, killing six people and flooding parts of Melaque and neighboring Barra de Navidad.

"There was a lot of flooding in the whole area, and we lost electricity," Galvez recalled. But this week, he said, only seven of his hotel's 26 rooms were occupied, and none of the hotel's guests were planning to leave.

A hurricane warning was up for Mexico's Pacific coast from Manzanillo, east of Melaque, northwestward to Cabo Corrientes. A hurricane watch and tropical storm warning were in effect from Punta San Telmo westward to east of Manzanillo.

Bud had been a Category 3 storm with maximum sustained winds of 115 mph (185 kph) late Thursday, but it was down to near 110 mph (175 kph) early Friday. The U.S. National Hurricane Center in Miami said Bud was expected to weaken further before hitting the coast late in the day, still at hurricane force.

The storm was centered about 105 miles (170 kilometers) southwest of Manzanillo and moving north-northeast near 8 mph (13 kph).

The Hurricane Center said the storm would likely move a little inland, then make a U-turn and head back out into the Pacific. That development would leave a small section of coast under hurricane and tropical-storm conditions for three days, raising the chance of heavy flooding.

The government of Jalisco state prepared hundreds of cots and dozens of heavy vehicles such as bulldozers that could be needed to move debris.

Officials in Puerto Vallarta said they were in close contact with managers of the hundreds of hotels in the city in case tourists need to move to eight emergency shelters. It said the sea along the city's famous beachfront was calm, but swimming had been temporarily banned as a precaution.

Jalisco state's civil defense office said two shelters had been opened in Cihuatlan, a town just inland from Melaque that was hard hit by flooding from Jova.

The office also said authorities had decided to open a trench to help drain a coastal lagoon near Melaque that was already full and could overflow.

The region is experienced at handling hurricanes, Galvez noted. "The government planning has helped a lot," he noted.

Oldest Jewish archaeological evidence on the Iberian Peninsula

ScienceDaily (May 25, 2012) ? Archaeologists of the Friedrich Schiller University Jena (Germany) found some of the oldest archaeological evidence so far of Jewish culture on the Iberian Peninsula at an excavation site in the south of Portugal, close to the city of Silves (Algarve). On a marble plate, measuring 40 by 60 centimetres, the name "Yehiel" can be read, followed by further letters which have not yet been deciphered. The Jena Archaeologists believe that the new discovery might be a tomb slab. Antlers, which were found very close to the tomb slab in the rubble gave a clue to the age determination.

"The organic material of the antlers could be dated by radiocarbon analysis with certainty to about 390 AD," excavation leader Dr. Dennis Graen of the Jena University explains. "Therefore we have a so-called 'terminus ante quem' for the inscription, as it must have been created before it got mixed in with the rubble with the antlers."

The earliest archaeological evidence of Jewish inhabitants in the region of modern-day Portugal has so far also been a tomb slab with a Latin inscription and an image of a menorah -- a seven-armed chandelier -- from 482 AD. The earliest Hebrew inscriptions known until now date from the 6th or 7th Century AD.

For three years the team of the University Jena has been excavating a Roman villa in Portugal, discovered some years ago by Jorge Correia, archaeologist of the Silves council, during an archaeological survey near the village of S?o Bartolomeu de Messines (Silves). The project was aiming at finding out how and what the inhabitants of the hinterland of the Roman province of Lusitania lived off. While the Portuguese coast region has been explored very well, there is very little knowledge about those regions. The new discovery poses further conundrums. "We were actually hoping for a Latin inscription when we turned round the excavated tomb slab," Henning Wabersich, a member of the excavation reports. After all, no inscriptions have been found so far and nothing was known about the identity of the inhabitants of the enclosure.

Only after long research the Jena Archaeologists found out which language they were exactly dealing with, as the inscription was not cut with particular care. "While we were looking for experts who could help with deciphering the inscription between Jena and Jerusalem, the crucial clue came from Spain" Dennis Graen says. "Jordi Casanovas Mir? from the Museu Nacional d'Art de Catalunya in Barcelona -- a well-known expert for Hebrew inscriptions on the Iberian Peninsula -- is sure that the Jewish name "Yehiel" can be read, -- a name that is already mentioned in the Bible." Not only is the early date exceptional in this case, but also the place of the discovery: Never before have Jewish discoveries been made in a Roman villa, the Jena Archaelogist explains.

In the Roman Empire at that time Jews usually wrote in Latin, as they feared oppressive measures. Hebrew, as on the re-discovered marble plate, only came back into use after the decline of the Roman supremacy, respectively in the following time of migration of peoples from the 6th or 7th century AD. "We were also most surprised that we found traces of Romans -- romanised Lusitanians in this case -- and Jews living together in a rural area of all things," Dennis Graen says. "We assumed that something like this would have been much more likely in a city."

Information about the Jewish population in the region in general was mostly passed down by scriptures. "During the ecclesiastical council in the Spanish town Elvira about 300 AD rules of conduct between Jews and Christians were issued. This indicates that at this time there must have been a relatively large number of Jews on the Iberian Peninsula already," Dennis Graen explains -- but archaeological evidence had been missing so far. "We knew that there was a Jewish community in the Middle Ages not far from our excavation site in the town of Silves. It existed until the expulsion of the Jews in the year 1497."

In the summer the Jena Archaeologists will take up their work again. Until now they have excavated 160 square metres of the villa, but after checking out the ground it already became clear that the greater part of the enclosure is still covered in soil. "We eventually want to find out more about the people who lived here," Graen explains the venture. "And of course we want to solve the questions the Hebrew inscription has posed us."

Leaders are tough and strong, but also humble. You should lecture, but do it softly, and keep in mind that you have to know servitude to be able to lead. A good leader is virtuous and full of integrity, something you need in order to be successful.

When you are developing yourself, always maintain self-discipline. Your body yearns to give into temptations, but you can control the desires with practice. Eliminate your flesh's desires, such as greed, drunkenness, lust, and overeating. If you can successfully control yourself, you are on the right path to lead a happy and healthy life.

You must have a positive attitude in order to grow as an individual. A negative attitude won't help you advance in life and may actually lead you down the wrong path. You should stay on a positive side of things and you will be more likely to reach your goals.

It is important to treat your body well and listen to its signals. Listen to the signals your body sends you: tiredness, hunger, pain or discomfort. Respond right away to them, for the sake of your health. You need a healthy body to serve you for years to come. Lapsing into poor health by not meeting your body's needs can have repercussions.

Strive to be the best at whatever it is you do. Use your passions to fuel your journey of personal fulfillment. While you cannot be the very best at something, you can aspire to ispire others in your field. Look for different ways to improve the quality of your work; your career and your self-esteem will surely benefit.

Staying positive takes a lot of willpower and it might mean that if you are positive towards others, then good things will come to you. You should only want the best to happen for others. Thinking positively can decrease the burden of negativity.

Choose one element of your life to focus on improving. Although you may have a long list of self-improvement goals, it can be more effective, and you will be more successful, if you tackle them one at a time. This means you will be able to maintain the changes as you turn them into habits as habits take time to stick.

Do you drink too often? Is smoking or anything else harming your body? Our bodies are important to maintain, and should be treated with care. Kicking your worst habits is a large part of becoming a happier and more healthy individual. Assess your life and what habits you have, and see if there are any that you could work on omitting.

Whereas trying to fix your problems yourself is always a great idea, sometimes you might have to seek out professional help. Books can be very helpful to help you understand your problems, but they tend to lack the insight and knowledge which a therapist can give you. Simply talking can help motivate you to succeed. The therapeutic discussion that you can have with a psychiatrist, is beyond the abilities of even the most comprehensive and detailed self-help book.

The most important person to please is yourself; your self-esteem and happiness should come before anyone else's opinion or desire. Do not become a self-centered person, but keep in mind that no one else will help you be a happier person than yourself. If you remain true to yourself while honoring your personal code of ethics, you will be better prepared to develop yourself more fully.

Eliminate all unnecessary stress from your life. When something happens try not to go overboard and over-react. Know that things go wrong in people's lives and you should find a way to deal with these instances.

Whatever your goals are, and however you are trying to reach them, there is one piece of advice, one thing to do, that is certain to be applicable. The thing you have to do is take action. Take charge of your life and refuse to take the role of a spectator. Don't be a spectator who isn't participating in your world. Take action and live!

Selfless behavior is a big leap forward in your personal development. Your inner character will benefit greatly from helping others, and making sacrifices to do it. Making sacrifices for others can help you to transcend feelings of selfishness and jealousy.

'Obesity genes' may influence food choices, eating patterns

ScienceDaily (May 23, 2012) ? Blame it on your genes? Researchers from The Miriam Hospital's Weight Control and Diabetes Research Center say individuals with variations in certain "obesity genes" tend to eat more meals and snacks, consume more calories per day and often choose the same types of high fat, sugary foods.

Their study, published online by the American Journal of Clinical Nutrition and appearing in the June issue, reveals certain variations within the FTO and BDNF genes -- which have been previously linked to obesity -- may play a role in eating habits that can cause obesity.

The findings suggest it may be possible to minimize genetic risk by changing one's eating patterns and being vigilant about food choices, in addition to adopting other healthy lifestyle habits, like regular physical activity.

"Understanding how our genes influence obesity is critical in trying to understand the current obesity epidemic, yet it's important to remember that genetic traits alone do not mean obesity is inevitable," said lead author Jeanne M. McCaffery, Ph.D., of The Miriam Hospital's Weight Control and Diabetes Research Center.

"Our lifestyle choices are critical when it comes to determining how thin or heavy we are, regardless of your genetic traits," she added. "However, uncovering genetic markers can possibly pinpoint future interventions to control obesity in those who are genetically predisposed."

Previous research has shown individuals who carry a variant of the fast mass and obesity-associated gene FTO and BDNF (or brain-derived neurotrophic factor gene) are at increased risk for obesity. The genes have also been linked with overeating in children and this is one of the first studies to extend this finding to adults. Both FTO and BDNF are expressed in the part of the brain that controls eating and appetite, although the mechanisms by which these gene variations influence obesity is still unknown.

As part of the Look AHEAD (Action in Health and Diabetes) trial, more than 2,000 participants completed a questionnaire about their eating habits over the past six months and also underwent geneotyping. Researchers focused on nearly a dozen genes that have been previously associated with obesity. They then examined whether these genetic markers influenced the pattern or content of the participants' diet.

Variations in the FTO gene specifically were significantly associated with a greater number of meals and snacks per day, greater percentage of energy from fat and more servings of fats, oils and sweets. The findings are largely consistent with previous research in children.

Researchers also discovered that individuals with BDNF variations consumed more servings from the dairy and the meat, eggs, nuts and beans food groups. They also consumed approximately 100 more calories per day, which McCaffery notes could have a substantial influence on one's weight.

"We show that at least some of the genetic influence on obesity may occur through patterns of dietary intake," she said. "The good news is that eating habits can be modified, so we may be able to reduce one's genetic risk for obesity by changing these eating patterns."

McCaffery says that while this research greatly expands their knowledge on how genetics may influence obesity, the data must be replicated before the findings can be translated into possible clinical measures.

After Wal-Mart, Illinois court & 7th Circuit uphold class certification ...

Class-action litigation returned to the spotlight with last year?s Supreme Court decision in Wal-Mart Stores, Inc. v. Dukes (131 S. Ct. 2541, 2011).? In Wal-Mart v. Dukes, the Supreme Court refused to certify what would have been the largest-ever employment class action against a private employer.

In the wake of the Supreme Court?s decision, it was uncertain how future class-action lawsuits would be affected by the ?commonality? requirement for class-action suits. Now the 7th Circuit has weighed in.

The latest ruling

In Ross v. RBS Citizens N.A. d/b/a Charter One (No. 10-3848, 7th Cir., 2012), the 7th Circuit held that two classes of employees who claimed they were denied overtime pay met the commonality requirement clarified by Wal-Mart v. Dukes.

In Ross, employees filed a class action against Charter One Bank, claiming it violated the Illinois Mini??mum Wage Law by refusing overtime pay. The employees sought to certify two classes.

The first class comprised nonexempt employees, who claimed that Charter One had an unofficial policy of denying them overtime pay by instructing them not to record overtime hours, giving them compensatory time instead of overtime and requiring them to work during unpaid breaks. ?

The second class was comprised of assistant branch managers who claimed that Charter One misclassified their positions as exempt, resulting in denial of overtime pay. ?

Classes approved

The district court granted the plaintiffs? motion to certify the two classes, finding that the plaintiffs satisfied the class-action requirements of numerosity, commonality, typicality and adequacy of representation. ?

Charter One appealed, arguing that the district court?s certification order did not comply with class-certification rules and that the two certified classes did not satisfy the commonality requirement set forth in Wal-Mart v. Dukes. ?

The issue was Rule 23(c)(1)(B), which requires a class certification to define the class and the class claims, issues or defenses. ?

The 7th Circuit held that the certification order must include a clear and precise statement of the parameters defining the classes to be certified, as well as a complete list of the claims, issues or defenses to be treated on a class basis. The 7th Circuit held that the district court?s certification order met this standard. ?

First, the certification order left no doubt that the class members consisted of all current and former employees who have worked at an Illinois Charter One location within the last three years who were subject to an unlawful overtime policy.

In addition, the certification order clearly identified the class of non-exempt employees who claimed that they were subject to a policy that intentionally failed to pay them overtime and the class of assistant bank managers who claimed that their primary duty was to perform non?-exempt work under an unlawful policy.

Comparison to Wal-Mart

As to the Wal-Mart v. Dukes commonality requirement, the 7th Cir??cuit held that the district court properly certified both classes.

In a class action, the plaintiff must show that there are questions of law or fact common to the class. Commonality requires the plaintiffs to show that the class members have suffered the same injury. ?

In this case, the 7th Circuit acknowl??edged that while there may be variations in how Charter One enforced its overtime policy, the glue that held together the two classes was based on the common question of whether an unlawful overtime policy prevented employees from collecting lawfully earned overtime pay.? ?

The 7th Circuit addressed and distinguished Wal-Mart v. Dukes from Ross based on the class size and the required type of proof. In Wal-Mart v. Dukes, the class consisted of 1.5 million female employees from 3,400 stores suing for sex discrimination under Title VII. The plaintiffs were required to show that Walmart store managers across the country had the same discriminatory intent in favoring men for promotions and raises. ?

In contrast, the classes in Ross consisted of 1,129 nonexempt employees and substantially fewer assistant bank managers who were all working in Illinois. In addition, unlike the Title VII claim in Wal-Mart v. Dukes, the Ross plaintiffs were not required to prove individual discriminatory intent under the Illinois Minimum Wage Law.

What it means for employers

While employers applauded the Wal-Mart v. Dukes decision, the Ross case serves as a reminder that employers challenging class-action certification still have substantial hurdles in defeating class certification.

This decision also reminds em??ployers that wage-and-hour litigation is the hot area for plaintiffs? attorneys. One misstep by employers in classifying employees or structuring payment policies can easily give rise to a class-action lawsuit, with significant liability. ?

An employer?s best defense is to have proper classification and em??ploy??ment policies in place. For that, employers should consult with counsel to ensure wage-and-hour compliance.

I know most people HATE running in the rain, but sometimes I prefer it to running on a sunny day. Take my Rock n Roll Half-Marathon (did I mention it was my first half-marathon EVER?!) that I ran last August. I may sound a little extreme when I say this, but it was literally like a monsoon. And I loved every minute of it! If I had been running in 90-degree weather in the city in August, I?m not sure I would have finished. But running a half-marathon in the rain was . . . refreshing. Other than causing me to wait in line for the porta-potty a couple of times, the constant downpour didn?t have much of an adverse effect on me. Then today, I went for a run . . . and it was amazing. I left my cell phone at home (see my last post reviewing my armband), which meant no GPS and no way to track my time, other than by using my iPod nano, which was set for the wrong time. It was just me, the road, and the rain. And what did I accomplish? A lot! Since I didn?t have my phone telling me when I hit each mile and what my time was, I wasn?t as worried about speeding up my pace at every mile to hit my goal time. But instead, I reached another ?goal,? which was to run my entire ?course? ? which includes running around my ENTIRE hilly block, including one the size of Grendall ? twice! And I felt great! It may seem like a small feat to some, but that 2.62 miles (it?s just a guess) was the best accomplishment I?ve made since I started running again! Here?s to more victories to come in the future! Huge multi-monitor enhancements coming in Windows 8

A post briefly appeared on the Building Windows 8 blog that outlined some of the new multiple monitor features that will be coming in Windows 8. We're not fully sure why the article is not available at the time of writing (at this link), but we luckily managed to pull a copy and tell you what's coming for multi-monitor users in Windows 8.

As is a common feature Microsoft has?opened the article with some statistics on multi-monitor users in Windows. According to their data, 85.32% of desktop and 95.64% of laptop users use just one monitor, leaving 14.68% and 4.36% using at least two monitors respectively. Microsoft recognizes the benefits of using two or more monitors for multitasking and they will be bringing a number of cool features to Windows 8 that will enhance using multiple monitors.

For improved wallpaper support Microsoft is adding a few new features. Firstly, multi-monitor users will be able to select different desktop backgrounds for each of their monitors, and where needed and configured (for example with different monitor sizes/resolutions or even orientation) Windows will shuffle through images that it thinks are most suited to the monitor set-up. Also, you'll be able to set a specific option that spans wallpapers across multiple monitors for cool effects.

Normally these desktop background features have only been available with third-party software, so it's great to see that Microsoft are going to efforts to improve the out-of-box experience.

Another major improvement that is coming is the multi-monitor taskbar that many users have complained about the lack of in Windows 7. In Windows 8, users will have the option to show the taskbar on secondary monitors, and then there will be options to choose how the application icons are shown on these taskbars. By default the app buttons will be shown on both taskbars, but you can set it to show app buttons only on the taskbar belonging to the monitor where the application is open.

Again these features have been limited to third-party software in the past, but due to users heavily requesting them they will be present in Windows 8.

Microsoft has also been working on improving the way the Metro Start Screen and apps are displayed on mulit-monitor set-ups, and starting with the Release Preview there will be new ways to display Metro items across two or more monitors. The Windows 8 team reports that while previously the Start screen and charms were only available on the one monitor, improvements will be made that will activate the gesture corners on all monitors.

This means that you will be able to show the Start screen and WinRT apps on whichever monitor you choose depending on what monitor you mouse to the bottom-left in. You'll also be able to bring up charms and the app switcher on any of your monitors, again depending on where you activate the gesture corners.

Finally Microsoft are improving the way the corners are activated, as with multiple monitors it can be extremely hard to get the corners to work without mousing to the next monitor. There will be a larger area that you can mouse to activate the Metro elements, and these will not interfere with moving between monitors.

The Windows 8 team close by saying how they have "lots of ideas for how [they] could do even more with Metro style apps on multiple monitors", including the possibility of multi-monitor APIs. While we wait for any more improvements, most of the features listed above will be coming with the Release Preview.

Penultimate (for iPad)


Apple's iPad gives you numerous ways to take notes, from typing on the virtual keyboard to writing on the touchscreen with a stylus or your finger. The note-taking app Penultimate (99 cents), recently purchased by the note-syncing and storage app company Evernote, is one of the best iPad note-taking apps around. It's fast, friendly, flexible, and at less than a buck, a bargain, all reasons it's an Editors' Choice. Using the app is second nature because it's nearly the same as doodling in a paper notebook. While the app's touch-based sophistication will no doubt impress consumers, when paired with a touch stylus like the Kensington Virtuoso ($24.99), Penultimate can scale to the professional demands of engineers, architects, and industrial designers. Not to mention that the app is optimized for the new iPad's high-resolution retina display.

The Penultimate iPad app doesn't have a keyboard, so it's not useful for typing notes. And it isn't quite as feature-rich as our other Editors' Choice Note Taker HD ($4.99, 4.5 stars)?although the latter costs five times as much. (For more recommendations, see "Note-Taking Apps for the iPad.")

Broad Strokes
Penultimate's interface looks familiar, though if there's any uncertainty, an interactive walkthrough takes just a couple of minutes to complete. You write in a virtual notebook, filled with blank, grid, or lined pages. The tools, a pen?fine, medium, or broad tipped, in ten shades?and eraser follow your finger or stylus across the page. New pages appear when you flip forward by touching the top corner of a page. Flipping between pages is nearly as smooth as thumbing the pages of a physical book, a testament to the app's speed.

Also worth mentioning are two controls through which you can improve usage. From the settings,you can move the toolbar?buttons for clearing a page, writing, and erasing?from the bottom of a page to the top. There's also a clever feature called Wrist Protection, which, automatically disregards stray marks from a resting wrist. Sometimes, especially when doodling, Wrist Protection can be overly protective, ignoring quick swipes, but when it comes to writing, it's a must.

Finger Painting
Penultimate organizes your work in terms of "Notebooks." Accessing different notebooks is as easy as returning to "My Notebooks" and swiping through the covers. Inside a notebook, you can create as many pages as you like. Unlike a notebook that comes in one style?blank, lined, or grid?with Penultimate, you can alternate between the three paper background styles. An in-app connection to The Paper Shop allows you to buy additional paper styles, such as sheet music paper, should you choose. A few are free, but most cost about a dollar.

If you make mistakes, as you will at first while getting used to writing with your finger or a new stylus, you can use either an eraser or an "undo" button. Multiple undos are supported, thankfully, and a redo button lets you toggle back if you undo too many actions.

The Penultimate iPad app doesn't have handwriting-to-text OCR, as the app Notes Plus ($7.99) does. So if you write by hand, the text stays in your handwriting, for better or worse. The iPad display doesn't tent to make handwriting look any worse than it already is, and if anything, smooths it slightly. Penultimate is fine for quick notes, and amazing for sketching or mind-mapping, but we wouldn't recommend it for heavy writing.

Art Gallery
Whether you're sharing in real time through a projector, distributing sketches as PDFs, or backing up files in iTunes, Penultimate is a capable companion. If you're looking to collaborate with colleagues, you can connect your pad to a projector via the Apple iPad VGA Adapter ($29). You can also share sketches via email. From inside a notebook, you can select either page or a full notebook to be attached as either a standard PDF or the proprietary .pen format.

Exported PDFs look great. There's even an option to include the paper background image, or convert it to flat white. You can import image files into your notebooks and mark them up with notes or just place them on a page and resize them however you want. Penultimate integrates well with Dropbox, Evernote (Penultimate is now owned by the company Evernote), and iTunes.

Your Last Pen
Penultimate for iPad, a PCMag Editors' Choice, is an excellent and ridiculously inexpensive note-taking app that is especially handy for those who have to sketch diagrams and images in their notes. Typists will lament the lack of a keyboard and should stick to Note Taker HD, our other Editors' Choice, instead. Tight integration with Dropbox and Evernote, two big players in the cloud syncing space, given Penultimate a little more utility than it would otherwise have on its own. Now that the product has been picked up by Evernote, we're excited to see what's in store next for this capable and already impressive app.

Jon Jones vs. Dan Henderson set for Labor Day weekend in Las Vegas

UFC light heavyweight champion Jon Jones knew that his next opponent was Dan Henderson, who once held that same title in Strikeforce. Now he has a date and a place: Sept. 1 in Las Vegas. UFC president Dana White announced the news on Twitter late Wednesday night.

For Henderson, the September date means he will have had nearly 10 months off between fights. His last bout was the Fight of the Year with Mauricio "Shogun" Rua, which Henderson won is five bloody rounds. He opted for the long layoff for the chance to win a UFC belt. Though he won a UFC tournament early in his career and has held belts in Strikeforce and Pride, Henderson has never been a UFC champion.

This will be just the second time Jones fights in 2012, a slowdown from the torrid pace he kept in 2011. He won a chance to fight for the belt, the belt, and then defended the title twice last year. With little time off between bouts, it's completely understandable that he wouldn't want to fight as often this year.

With this fight booking, the UFC will be putting every belt except welterweight on the line between Memorial Day and Labor Day weekends. However, with Dominick Cruz's injury, Urijah Faber will be competing for an interim belt.
